2. Purposes of processing and legal basis
Your personal data will be processed for the following purposes:
a) Contact form
- Purpose: To manage and answer queries, requests for information, complaints or suggestions received through the contact form.
- Legal basis: Your consent (Art. 6.1.a GDPR), given by ticking the acceptance box and sending the form.
- Retention: Data will be kept only for as long as needed to handle and answer your request.
b) CVs (“Jobs” form)
- Purpose: To manage your application and your participation in current or future recruitment processes at Hermanos Vinagre.
- Legal basis: Your consent (Art. 6.1.a GDPR), given when you send us your CV and tick the acceptance box.
- Retention: Data will be kept for one year from the day we receive your CV, so we can consider you for future recruitment processes, unless you withdraw your consent earlier. After that, it will be deleted.
c) Bookings (by phone or email)
- Purpose: To manage your booking request at our premises, the provision of the service and related communications (confirmation, reminder, cancellation).
- Legal basis: Taking steps prior to entering into a contract, or the performance of a service contract (Art. 6.1.b GDPR).
- Retention: Data will be kept for as long as the contractual relationship lasts and, afterwards, for the periods required by law to deal with any possible liabilities (generally, tax and commercial periods).
d) Newsletter (news form)
- Purpose: To email you our news (openings, plans at the bars and product launches), according to the city you tell us.
- Legal basis: Your consent (Art. 6.1.a GDPR), given by ticking the acceptance box. You can withdraw it at any time using the unsubscribe link included in every email.
- Retention: Data will be kept until you unsubscribe.
e) Catering quotes
- Purpose: To prepare and send you the quote you requested and, if you accept it, to organise the service.
- Legal basis: Your consent (Art. 6.1.a GDPR), given by ticking the acceptance box, and, if you book the service, the performance of the contract (Art. 6.1.b GDPR).
- Retention: Data will be kept for as long as needed to answer your request and, if you book the service, for the periods required by law.
f) Brand collaboration proposals
- Purpose: To review and answer collaboration proposals sent to us by brands and companies.
- Legal basis: Your consent (Art. 6.1.a GDPR), given by ticking the acceptance box and sending the form.
- Retention: Data will be kept for as long as needed to review the proposal and reply and, if we end up collaborating, for as long as the collaboration lasts.
g) Online shop purchases
- Purpose: To manage your order, payment, delivery or collection at the bar, and any returns.
- Legal basis: The performance of the sales contract (Art. 6.1.b GDPR) and compliance with legal obligations, such as tax obligations (Art. 6.1.c GDPR).
- Retention: Data will be kept for as long as the contractual relationship lasts and, afterwards, for the periods required by law (generally, tax and commercial periods).
h) Shop availability alerts (“Let me know”)
- Purpose: To email you when the shop product you indicate (and the size, if you choose one) becomes available.
- Legal basis: Your consent (Art. 6.1.a GDPR), given by ticking the acceptance box and sending the form.
- Retention: Data will be kept until the alert is sent or you ask us to delete it.
3. Recipients of the data
Hermanos Vinagre will not pass your personal data on to third parties unless required by law. To manage our services properly, service providers (e.g. accountants, web hosting) and, only if you accept analytics cookies, Google (Google Analytics), which measures visits, may need access to your data, always under our control and with appropriate confidentiality guarantees (data processing agreements).
If you buy in the online shop, we will provide the necessary data to the payment gateway and to the courier delivering your order.
4. Your rights
You have the right to:
- Access your personal data.
- Request the rectification of inaccurate data.
- Request the erasure of your data (right to be forgotten).
- Request the restriction of the processing of your data.
- Object to the processing of your data.
- Request the portability of your data.
You can exercise your rights by sending a written request, together with a copy of your ID card or equivalent identity document, to our registered office at Calle Martínez de la Rosa 16, Local 2, 08012 Barcelona, or by email to info@hermanosvinagre.com.
Likewise, if you consider that your data is not being processed properly, you have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
5. Accuracy of the data
The User guarantees that the data provided is true, accurate, complete and up to date, and is responsible for any direct or indirect loss or damage that may result from failing to comply with this obligation.
